Overview

1.1 Road Ninja recognises the importance of protecting your privacy. This Privacy Statement explains how Road Ninja may collect, hold, use and disclose information that identifies you ( your personal information).

1.3 In this Privacy Statement, Road Ninja means Road Ninja Limited. Capitalised terms used and not defined in this Privacy Statement have the meaning given to them in the Road Ninja Terms of Use available on our Website.

Application of this Privacy Statement

1.4 Please read this Privacy Statement carefully. It applies to any personal information that you provide to Road Ninja or authorise us to collect. By providing Road Ninja with personal information, or using the Road Ninja Platform (including our mobile application( App)) which is available at https://app.roadninja.co.nz/ and website available at https://roadninja.co.nz/ ( Website) or other Road Ninja services, you authorise us to collect, use and disclose your personal information in accordance with this Privacy Statement.

Updates to this Privacy Statement

1.5 Road Ninja may update this Privacy Statement at any time by posting an updated version of this Privacy Statement on the Road Ninja Website. The updated version of this Privacy Statement will take effect immediately upon publication (or, if applicable, on the date specified in the updated Privacy Statement) and will apply to all personal information that we hold about you. If the changes are material, we may also take additional steps to bring the changes to your attention, including by notifying you directly. We will update you of any material changes as required by law.

Additional rights and obligations

1.6 This Privacy Statement applies in addition to, and does not limit, our rights and obligations under the Privacy Act 2020 (as amended or replaced from time to time) (Privacy Act) or any specific authorisation that you provide to us when you interact with us or use our services.

1.7 You are not required to provide us with any personal information that we request. However, if you do not do so, we may not be able to provide certain services to you.

Important Notice: New Zealand residents

1.8 The Road Ninja Website and App and our other services are intended for New Zealand residents only. If you are located in another country you may be subject to other laws, including data protection laws. For that reason, if you are not located in New Zealand you are not permitted to use, and must immediately cease using, the Road Ninja Platform and other services.

2. Collection of personal information

Types of personal information we collect

2.1 The personal information we collect will vary depending on the services that you use, and your interactions with us. For example, we may collect your:

(a)
name, address, telephone numbers, e-mail addresses;
(b)
demographic information such as your:

date of birth;
gender; and
city of residence.

your previous addresses in New Zealand in the last 10 years;
whether you have been known by any other names;
if you live or have lived outside of New Zealand in the past 10 years, your country of residence over that time and your driving history in that country;
your location information to facilitate services on our App such as searching for and booking jobs, Customer view of Transportation Contract progress, live traffic updates and notifications to Customers. We may also use your location information to provide Customer or Driver support, and prevent and detect fraudulent use of the App;
a copy of your driver licence and passport and a utility bill confirming your address;
your bank account details; and
your driving history (see further detail below);

(d)
your preferences for use of services, such as locations and job types;
(e)
information about your activity using Road Ninja, such as jobs you book or complete on the Road Ninja Platform;
(f)
feedback that you provide (for example, your reviews on the App or comments on Facebook or other social media);
(g)
reviews about you (from other users of the Road Ninja Platform); and
(h)
any other information you provide to us or authorise us to collect.

How we collect personal information

2.2 Generally, we collect personal information directly from you. For example, when you:

(a)
use the Road Ninja Platform or our App;
(b)

use services provided by our related companies or businesses from time to time (including Log Ninja); and
(c)
communicate with us online, including customer support.

2.3 We may collect your personal information from a third party if you have authorised them to provide, or authorised us to collect, that information. For example:

(a)
when you use the Road Ninja Website or App we may use third party analytics technology to collect information (see “Use of personal information below”);
(b)
if you are a Driver, as part of your on boarding process for the Road Ninja Platform (or at any other time) and ongoing use of Road Ninja we may:
(c)
use the services of New Zealand Transport Agency, the Accident Compensation Corporation, and the Ministry of Justice to check your driving, accident and criminal history; and
(d)
use the services of EROAD Logbook; and
(e)
undertake reference checks regarding your driving history and performance by contacting the employment and/or reference checks that you provide to us.

2.4 We may also collect information about you (whether you are a Driver or Customer) from other users of our services through reviews on the Road Ninja Website and App.

2.5 You may choose to limit the personal information you provide to Road Ninja. You should be aware, however, that if you choose not to provide certain personal information to us, this may mean that we do not provide you access to the Road Ninja Platform, or that we are unable to provide certain services to you.

Payment information

2.6 If you make a payment via the Road Ninja Website or App, our payment gateway provider will process your payment. Our current provider is Stripe New Zealand Limited (Stripe). Stripe will process your payment information, in accordance with Stripe’s Privacy Statement available at https://stripe.com/nz/privacy . Your payment card number is not held by and is never revealed to us.

Information about other people

2.7 If you provide us with, or authorise us to collect, personal information about another person, you confirm that they have authorised you to provide us, or authorise us to collect, their personal information in accordance with this Privacy Statement and that you have informed them of their rights to access and request correction of their personal information, as set out below.

Analytics and Cookies

2.8 When you use the Road Ninja Website or App we may also collect information that does not identify you (or any other individual), such as analytical information about the computer or mobile device used and its use of the Road Ninja Website or App. We use the information for statistical reporting and analytics and do not link it to any named individuals.

2.9 For example, data about your visit, based on your IP address, is automatically logged. This information is used to see where the Website or the App is being used to ensure coverage, and for click stream analysis to help better understand and design our Website and App.

2.10 When you use the Road Ninja Website, short text files called “cookies” may be automatically downloaded to your computer or mobile device. Cookies enable us and our third party service providers to provide you with a better experience. For example, by enabling the Website to know that you have visited before and in some cases to record preferences in order to personalise your visit. Cookies also assist us and our third party service providers to analyse the profile of our visitors. These can be session cookies which are deleted when you close your browser and/or persistent cookies which remain on your computer or mobile device for a longer period of time. To delete or stop cookies being placed on your computer refer to the help menu on your internet browser. In a few cases blocking cookies may reduce the functionality of the Road Ninja Platform or otherwise prevent access to them depending on your chosen browser options. 3. Use of personal information

3.1 Road Ninja may use your personal information for the following purposes:

(a)

confirming that you meet the Road Ninja eligibility criteria for a Driver or Customer (as applicable), as set out in our Terms of Use available on our Website, including verifying your identity and completing the checks referred to above;
(b)
for the general operation of the Road Ninja Platform and our relationship with you – including connecting you with Drivers or Customers (as applicable) and facilitating the entry into Transportation Contracts between Drivers and Customers;
(c)
marketing our services to you and sending you information about other goods and services that we think might be of interest to you (unless you have opted outed out of receiving any marketing communications);
(d)
improving our services and the functionality of our Website and App, including through third parties’ technology services (for example, by recording screens visited on the Road Ninja Platform and your interaction patterns such as taps and scrolls);
(e)
complying with our legal and regulatory requirements and record keeping practices; and
(f)
for any other purpose authorised by you or permitted by law.

3.2 We may also use any information that we collect, in accordance with applicable law, to improve our products and services, for statistical and research purposes, and for general information purposes including to provide industry and market insights. Any information that we disclose or publish will be in a fully aggregated and de-identified form (to ensure that it does not identify any individuals).

Feedback

3.3 If you share feedback, including ideas, recommendations, proposals, strategies or other content (Feedback) with us (including sharing Feedback via our service provider, Frill), we may use, reproduce, publish or share your Feedback without limitation.

3.4 We may monitor, modify or remove content that we determine to be illegal, inappropriate, potentially harmful, defamatory, or in violation of intellectual property rights or this Privacy Statement. You confirm that your feedback will not infringe on any copyright, trademark, privacy, rights of publicity, or other personal or proprietary rights under New Zealand law. You are solely accountable for the accuracy of your feedback. We hold no responsibility for feedback provided by you or any third party.

3.5 We may communicate with you by email and other electronic means.

4. Disclosure of personal information

4.1 Road Ninja may share your personal information with the following parties:

(a)

our related companies or businesses from time to time ( including Log Ninja), who may use your personal information in accordance with their privacy statement, including to send you information about their goods and services (unless you have opted out of receiving any marketing communications) (for further information about Log Ninja refer to Log Ninja’s Privacy Statement);
(b)
organisations, partners, contractors, insurers and service providers (including IT and identity verification services providers), to assist us with the operation of the Road Ninja Platform and other business activities;
(c)
other Users to enable us to provide Road Ninja Platform services, for example:

if you are a Driver and you wish to provide Transportation Services to a Customer, you authorise us to feature your personal information (such as your name, driver licence class, job preferences and information on your background checks) on the Road Ninja Platform and disclose your personal information to a Customer to facilitate the Transportation Contract, including to enable a Customer to decide whether to enter a Transportation Contract with you;
if you are a Driver, you authorise us to show your driving and/or job history and the feedback of other Users on the Road Ninja Platform; and
each User authorises us to share personal information to assist with resolving complaints and disputes.

(d)
any other party authorised by you or to whom we are required or authorised to disclose personal information in accordance with applicable law.

Overseas disclosure

4.2 If we send personal information overseas either directly or via a third party, we will ensure that any such transfer of personal information will only be undertaken in compliance with applicable laws, including the Privacy Act.

5. Storage of personal information

Storage

5.1 Personal Information that we collect is either held by us at our head office (refer to the Contact Us section below) or on our behalf. For example, some information we hold will be stored in “the cloud” in secure databases on our behalf by third parties based overseas such as Amazon Web Services. The use of these services, and the transfer of information overseas (if applicable) will not relieve us of our obligations under the Privacy Act and this Privacy Statement.

Security

5.2 Security of your information is very important to us. We will take reasonable technical and organisational safeguards to protect personal information that we hold. However, due to the inherent nature of the internet, we are not able to guarantee the security of any information that we hold or that you transmit to us via the Road Ninja Platform or otherwise. As discussed above (Payment Card Information), if you make a payment via our Website, our payment gateway provider, Stripe, will process your payment and your payment card number is never revealed to us.

Updates

5.3 We rely on you to update us if your contact details change (please refer to the Contact Us section below).

6. Access and correction of personal information

6.1 Under the Privacy Act, you have the right to access and request correction of any personal information that we hold about you. Please refer to the Contact us section below.

7. Deletion of personal information

7.1 You may request deletion of your account or data at any time through the Settings {'>'} Delete account option in the Road Ninja app, or by emailing support@roadninja.co.nz. Following a deletion request, we will delete your data as requested, unless we consider it necessary to retain that information (for example, if we are legally required to keep that information for a minimum period). Where we agree to delete your data, we will generally do so within 90 days of your deletion request.
