1.4 Please read this Privacy Statement carefully. It applies to any personal information that you provide to Road Ninja or authorise us to collect. By providing Road Ninja with personal information, or using the Road Ninja Platform (including our mobile application( App)) which is available at https://app.roadninja.co.nz/ and website available at https://roadninja.co.nz/ ( Website) or other Road Ninja services, you authorise us to collect, use and disclose your personal information in accordance with this Privacy Statement.
Updates to this Privacy Statement
1.5 Road Ninja may update this Privacy Statement at any time by posting an updated version of this Privacy Statement on the Road Ninja Website. The updated version of this Privacy Statement will take effect immediately upon publication (or, if applicable, on the date specified in the updated Privacy Statement) and will apply to all personal information that we hold about you. If the changes are material, we may also take additional steps to bring the changes to your attention, including by notifying you directly. We will update you of any material changes as required by law.
Additional rights and obligations
1.6 This Privacy Statement applies in addition to, and does not limit, our rights and obligations under the Privacy Act 2020 (as amended or replaced from time to time) (Privacy Act) or any specific authorisation that you provide to us when you interact with us or use our services.
1.7 You are not required to provide us with any personal information that we request. However, if you do not do so, we may not be able to provide certain services to you.
Important Notice: New Zealand residents
1.8 The Road Ninja Website and App and our other services are intended for New Zealand residents only. If you are located in another country you may be subject to other laws, including data protection laws. For that reason, if you are not located in New Zealand you are not permitted to use, and must immediately cease using, the Road Ninja Platform and other services.

Payment information
2.6 If you make a payment via the Road Ninja Website or App, our payment gateway provider will process your payment. Our current provider is Stripe New Zealand Limited (Stripe). Stripe will process your payment information, in accordance with Stripe’s Privacy Statement available at https://stripe.com/nz/privacy . Your payment card number is not held by and is never revealed to us.

2.7 If you provide us with, or authorise us to collect, personal information about another person, you confirm that they have authorised you to provide us, or authorise us to collect, their personal information in accordance with this Privacy Statement and that you have informed them of their rights to access and request correction of their personal information, as set out below.
Analytics and Cookies
2.8 When you use the Road Ninja Website or App we may also collect information that does not identify you (or any other individual), such as analytical information about the computer or mobile device used and its use of the Road Ninja Website or App. We use the information for statistical reporting and analytics and do not link it to any named individuals.
2.9 For example, data about your visit, based on your IP address, is automatically logged. This information is used to see where the Website or the App is being used to ensure coverage, and for click stream analysis to help better understand and design our Website and App.
2.10 When you use the Road Ninja Website, short text files called “cookies” may be automatically downloaded to your computer or mobile device. Cookies enable us and our third party service providers to provide you with a better experience. For example, by enabling the Website to know that you have visited before and in some cases to record preferences in order to personalise your visit. Cookies also assist us and our third party service providers to analyse the profile of our visitors. These can be session cookies which are deleted when you close your browser and/or persistent cookies which remain on your computer or mobile device for a longer period of time. To delete or stop cookies being placed on your computer refer to the help menu on your internet browser. In a few cases blocking cookies may reduce the functionality of the Road Ninja Platform or otherwise prevent access to them depending on your chosen browser options. 3.3 If you share feedback, including ideas, recommendations, proposals, strategies or other content (Feedback) with us (including sharing Feedback via our service provider, Frill), we may use, reproduce, publish or share your Feedback without limitation.
3.4 We may monitor, modify or remove content that we determine to be illegal, inappropriate, potentially harmful, defamatory, or in violation of intellectual property rights or this Privacy Statement. You confirm that your feedback will not infringe on any copyright, trademark, privacy, rights of publicity, or other personal or proprietary rights under New Zealand law. You are solely accountable for the accuracy of your feedback. We hold no responsibility for feedback provided by you or any third party.

4.2 If we send personal information overseas either directly or via a third party, we will ensure that any such transfer of personal information will only be undertaken in compliance with applicable laws, including the Privacy Act.
Storage
5.1 Personal Information that we collect is either held by us at our head office (refer to the Contact Us section below) or on our behalf. For example, some information we hold will be stored in “the cloud” in secure databases on our behalf by third parties based overseas such as Amazon Web Services. The use of these services, and the transfer of information overseas (if applicable) will not relieve us of our obligations under the Privacy Act and this Privacy Statement.

5.2 Security of your information is very important to us. We will take reasonable technical and organisational safeguards to protect personal information that we hold. However, due to the inherent nature of the internet, we are not able to guarantee the security of any information that we hold or that you transmit to us via the Road Ninja Platform or otherwise. As discussed above (Payment Card Information), if you make a payment via our Website, our payment gateway provider, Stripe, will process your payment and your payment card number is never revealed to us.

6.1 Under the Privacy Act, you have the right to access and request correction of any personal information that we hold about you. Please refer to the Contact us section below.
7.1 You may request deletion of your account or data at any time through the Settings {'>'} Delete account option in the Road Ninja app, or by emailing support@roadninja.co.nz. Following a deletion request, we will delete your data as requested, unless we consider it necessary to retain that information (for example, if we are legally required to keep that information for a minimum period). Where we agree to delete your data, we will generally do so within 90 days of your deletion request.
